This development has chosen to opt-out from the Inclusionary Zoning Ordinance and pay the In-Lieu Fee. The In-Lieu Fee is the combined totals of the construction costs and the land costs, times the number ofaffordable units at either 10% of the total units at 60% of Area Median Income (AMI) or 15% of the total units at 80% of AMI as established by Department of Housing and Urban Development (HUD), for the sub-area in which the affordable units would have beenconstructed. A project must have ten (10) or more multi-family units under construction to be compliant with the Ordinance or to opt-out. The applicant must pay the total opt-out prior to the issuance of a building permit. Once this cost has been documentedin Accela, and confirmed by OHCD, the building permit can be issued.
