RESPONSES TO STAFF: Transportation 1. Agreed, final language matches approved TIS. 2. Agreed, will improve Northbend and Heritage Lake assuming there is available ROW and no new ROW needs to be acquired. Site and Building Design 1. Agreed, Petitioner has added live-work units as a non-residential component to the rezoning request. 2. Petitioner needs flexibility in unit type due to unpredictability of market conditions given the multi-phase/multi-year build-out. We have incorporated thresholds as previously discussed with Staff. 3. We have added duplex and triplex into the development standards language and designated specific areas where buildings may only contain a maximum of 3 units (i.e., triplex). 4. Labels as written are tied to the development standards to provide designated areas and would be cumbersome to change. If necessary, we can change these after Zoning Committee but it was too onerous of a task to complete with accuracy given this short turn-around time between the hearing and resubmittal. 5. Areas have listed uses in the development standards but it would be too crowded and illegible to add these labels for each development area onto the plan. Confirmed ok with Staff.

It is recommended that the applicant contact the Charlotte Water New Services group for further information and to discuss options regarding sanitary sewer system capacity. Charlotte Water has accessible water system infrastructure for the rezoning boundary via an existing 8-inch water distribution main located along both Sir Anthony Dr and Heritage Lake Dr. Charlotte Water has accessible sanitary sewer system infrastructure for the rezoning boundary via an existing 8-inch gravity sewer main located through the middle of the parcel. The proposed rezoning has the potential to significantly impact the capacity of the local sanitary sewer collection system. Due to the limited project details that were provided, it is recommended that the applicant contact the Charlotte Water New Services group for further information and to discuss options regarding sanitary sewer system capacity. Charlotte Water New Services group is available at (704) 432-2854. Development is encouraged to contact Installation Development Services at (704) 336-5499 to review service connection design requirements and City Ordinances (e.g., backflow, separate meter Ordinance, public/private pipeline extensions). Comments: Will need to acquire CAP. Has direct access to water/sewer. Depending on the required public street network, this site will be required to extend public water/sewer to serve their site. Contact our New Services Department for water/sewer services. Will need to send plans to Charlotte Water for private water permitting. Will need to send plans to NCDEQ for private sewer permitting. Reservation of sanitary sewer system capacity through the Charlotte Waterâ€™s Capacity Assurance Program is the responsibility of the customer/development.
