Resolution of outstanding items: Ã¢â‚¬Â¢ Transportation 1. Label and dimension proposed curb & gutter, planting strip, and multi-use path from centerline of West Mallard Creek Church Road. Curb and gutter is now noted to be constructed along Mallard Creek Road at the existing edge of pavement and dimension has been provided. MUP and planting strip note has been updated to provide ability to locate the MUP and planting strip in zone between back of curb and right of way, with ability to locate outside of R/W with SUE should NCDOT not allow these items inside the R/W. 2. Site plan and conditional note(s) revisions are needed to remove the proposed left over from the site plan. Per NCDOT comments, this movement will not be permissible. This left over is being constructed by a previously approved City of Charlotte Land Development Project (SDRU-2021-00003). To avoid confusion, we have removed the note from this rezoning as it is being constructed by a currently active construction project. 3. Add conditional note that Wright Hill Road will be extended and aligned to create a 4th leg at Mallard Creek and Mallard Glen Drive, if necessary, easements can be acquired, and the street extension can be properly engineered. Proposed right-in/right-out access will be allowed if realignment of Wright Hill Road is not feasible in consultation with NCDOT and CDOT. Conditional note has been added as item III.E Ã¢â‚¬Â¢ Site and Building Design 1. Clarify setback along West Mallard Creek Church Road. The ordinance required setback would fall within the proposed Mallard Creek Road right of way, and therefore, would adjust to the more restrictive condition which is the Right of Way line as currently shown. The Proposed Mallard Creek Right of Way is also labeled as the Setback. ADDITIONS: - added justification for the height/density similar to UDO bonus, based on council discussions

Charlotte Water currently does not have sewer system accessibility for the rezoning boundary under review. The closest available sewer main is approximately 425 feet northeast of the rezoning boundary on Mallard Glen Dr. The applicant should contact Charlotte Waterâ€™s New Services at (704) 432-2854 for more information regarding accessibility to sewer system connections. Development is encouraged to contact Installation Development Services at (704) 336-5499 to review service connection design requirements and City Ordinances (e.g., backflow, separate meter Ordinance, public/private pipeline extensions). Comments: Has direct access to sewer. Has direct access to water. Contact CLT Water New Services Department for water/sewer services. Contact CLT Water Donated Projects if public infrastructure will be extended through property. Storm Water Impacts

Description:

This property drains to Mallard Creek, which is an impaired/degraded stream, and may contribute to downstream flooding. This project has the opportunity to mitigate future impacts to this stream, therefore, Storm Water recommends placing the following notes on the plan: (I) Storm Water Quality Treatment For defined watersheds greater than 10% built-upon area (BUA), construct water quality stormwater control measures (SCMs) designed for the runoff generated from the first 1-inch of rainfall for all new and redeveloped BUA associated with the project. SCMs must be designed and constructed in accordance with the Charlotte-Mecklenburg BMP Design Manual. (II) Volume and Peak Control For defined watersheds greater than 10% built-upon area, control the entire volume for the 1-year, 24-hour storm for all new and redeveloped BUA associated with the project. Runoff volume drawdown time shall be in accordance with the Charlotte-Mecklenburg BMP Design Manual. For commercial projects with greater than 10% BUA, control the peak to not exceed the predevelopment runoff rates for the 10-yr, 6-hr storm and perform a downstream flood analysis to determine whether additional peak control is needed and if so, for what level of storm frequency, or if a downstream analysis is not performed, control the peak for the 10-yr and 25-yr, 6-hour storms. For residential projects with greater than 10% BUA, control the peak to not exceed the predevelopment runoff rates for the 10-year and 25-year, 6-hour storms or perform a downstream analysis to determine whether peak control is needed, and if so, for what level of storm frequency. Staff is available to discuss mitigation options prior to the rezoning plan approval should the project have practical constraints that preclude providing the above referenced stormwater management.
