Type: condition Title: Optional Provisions Context/Reasoning Description: Similarly to 2023-040, it would be helpful to have a bit more contextual info on why some of these optional provisions are needed. Type: condition Title: Future Redevelopment Language Description: Why doesn't this plan have the same language as 2023-040 stating that if redevelopment other than the CTC uses were to take place, redevelopment would use provisions of UMUD without the optional provisions stated in this plan? Type: note Title: Rail Trail Setback Description: The proposed Optional Provisions would not allow sufficient space for a future Rail Trail addition along the Track 1 side of the Blue Line alignment.
As depicted on the Blue Line as-builts, Typical Section #37 indicates a 15โ dimension from the track centerline to the edge of the ballast curb. Typically, a Rail Trail section 20โ wide (12โ sidewalk and 8โ planting strip(s)) is required along the edge of the ballasted track area. This is how the โRail Transit Setback from 35-feet from the rail centerlineโ is calculated. If an extension of the Rail Trail between the 3rd Street and CTC/Arena Stations is an objective, then the setback must reserve sufficient space for the Rail Trail.
Other details of note are that the width of the retaining wall supporting the track section and a future wall supporting the Rail Trail may effectively reduce the planting strip area envisioned in the 35 foot requirement. The cross-section of the Rail Trail on the Track 2 side is not the standard 20 foot section typically provided elsewhere so site needs may be considered. The project team should determine a desired Rail Trail cross-section for this area. Type: condition Title: Add note Description: This property drains to Upper Little Sugar creek, which is an impaired/degraded stream, and may contribute to downstream flooding. This project has the opportunity to mitigate future impacts to this stream, therefore, Storm Water recommends placing the following notes on the plan:
(I) Storm Water Quality Treatment
For defined watersheds greater than 24% built-upon area (BUA), construct water quality stormwater control measures (SCMs) designed for the runoff generated from the first 1-inch of rainfall for all new and redeveloped BUA associated with the project. SCMs must be designed and constructed in accordance with the Charlotte-Mecklenburg BMP Design Manual.
(II) Volume and Peak Control
For defined watersheds greater than 24% built-upon area, control the entire volume for the 1-year, 24-hour storm for all new and redeveloped BUA associated with the project. Runoff volume drawdown time shall be in accordance with the Charlotte-Mecklenburg BMP Design Manual.
For commercial projects with greater than 24% BUA, control the peak to not exceed the predevelopment runoff rates for the 10-yr, 6-hr storm and perform a downstream flood analysis to determine whether additional peak control is needed and if so, for what level of storm frequency, or if a downstream analysis is not performed, control the peak for the 10-yr and 25-yr, 6-hour storms.
For residential projects with greater than 24% BUA, control the peak to not exceed the predevelopment runoff rates for the 10-year and 25-year, 6-hour storms or perform a downstream analysis to determine whether peak control is needed, and if so, for what level of storm frequency.
Staff is available to discuss mitigation options prior to the rezoning plan approval should the project have practical constraints that preclude providing the above referenced stormwater management.
