This user agreement governs your use of this online service.  By utilizing this online service, you agree to comply with all of the terms and conditions of this user agreement.  Please carefully read the terms of this user agreement, including links to terms found herein that apply to you including the County of Santa Barbara's (County) Terms of Service, External Links Policy and Privacy Policy which are incorporated by reference into this user agreement, available at https://www.countyofsb.org/terms.sbc.

You agree to access and use the online service only for lawful purposes.  You are solely responsible for the knowledge of and adherence to all applicable laws, statutes, rules, and regulations pertaining to your use of the online services.  You agree you shall not use this online service to (i) commit a criminal offense or give rise to civil liability, or encourage others to do so; (ii) impersonate others; (iii) upload any material that may alter, damage, or interrupt the functionality of the online service or the hardware or software of any other person who may access the online service; (iv) upload or otherwise transmit any materials that you do not have a right to transmit under law or contractual relationship; (v) disrupt the online services, the County's servers or networks or the servers or networks of a third party service provider, or (vi) claim a relationship with or represent any business, association, or other organization with which you are not authorized to claim such a relationship or to represent.

You warrant and guaranty that the information you provide to the County shall be accurate and you understand that the County relies on this information in providing the service.  Your failure to adhere to these terms may result in termination of your ability to use the online service; criminal activity on this site may be referred to law enforcement.  You agree to indemnify, defend (with counsel reasonably approved by County) and hold harmless, the County and its officials, employees, and agents from and against any and all claims, actions, losses, damages, judgments, and/or liabilities arising out of your use of the service in violation of this user agreement.

Privacy

By utilizing this online service, you are choosing to voluntarily share information with the County.  This information is used to fulfill the purpose for which you are providing the information, such as to submit an application or pay for requested permits.  

You are responsible for maintaining adequate security and control of any and all IDs, passwords, personal identification numbers, or any other codes that you use to access your account and the online services.  

We engage authorized service providers to provide these online services to you, including for credit card payment processing.  In order for these service providers to appropriately deliver services, we may share information with them that you provide through your use of the online service.  

The County does not sell information collected and provided through this website.  The County is subject to public disclosure of certain information as required by federal, state, or local laws, rules or regulations, including but not limited to the California Public Records Act (Gov Code Sec 6250 et seq.), unless an exception applies.  Exceptions may include the withholding of sensitive information to protect the privacy of individuals.  In the event of a conflict between this user agreement and the California Public Records Act or other law governing the disclosure or protection of information and records, the applicable law will control.

Please note that we do not alter our Site's data collection and use practices when we see a Do Not Track signal from your browser.

Governing Law and Jurisdiction

This user agreement is entered into the County of Santa Barbara, California and shall be governed by and construed in accordance with the laws of the State of California.  Any litigation regarding this Agreement or its contents shall be filed in the County of Santa Barbara, if in state court, or in the federal district court nearest to Santa Barbara County, if in federal court.

Entire Agreement and Amendment

This user agreement and the links to terms found herein, constitute the entire agreement between you and the County pertaining to your use of the online service.  The County may revise this user agreement and any of the other terms, agreements, or policies referenced herein from time to time.  The revised version will be effective at the time we post it, unless otherwise noted.  By continuing to use our services after any changes to this user agreement or any of the other applicable terms, agreements or policies, you agree to abide and be bound by those changes.  If you do not agree with the terms of or any changes to this user agreement you may choose not to use the online service or close your account.
